Terms and conditions

These terms and conditions of use of the service regulate the user's access and use of the Capital Digital website (hereinafter the Site) and any game, mobile application, application programming interface, and other services found within it, as well as any of its subsidiaries that make up the Services.

Capital Digital S.A.PI. de C.V. is the owner of the site and the service providers.
By using the Site or services, the user accepts these Terms and Conditions, as well as the Privacy Policy. Please read carefully, if you do not agree with the provisions herein, you are urged not to use our services.

  1. Access

    In order to access and use the Services, the user must be at least the age of majority in the state or country of residence. In the event that the User has not reached the age of majority in his or her state or country of residence, his or her parent or legal guardian must consent on his or her behalf, to the extent that they agree to the Terms of Service and our Privacy Policy.

    For users within the European Union, the User must be at least 16 years of age to access and/or use the Services. If the User is under 16 years of age, he/she must have the consent of his/her legal guardian and only to the extent that the legal guardian agrees with these Terms of Service to access and/or use the Services. If the user's applicable national law permits, the user under 16 years of age may access the service, provided that the user is not younger than 13 years of age.


  2. Correct use of the services.

    The user is responsible for the use that can be made of the Site and the Services, both by oneself and made through their account. Our purpose is to create a positive, useful, and safe experience which is why certain behaviors may be harmful to other users or to the site itself. Therefore, the user is forbidden to:
    • Violate any law or regulation;
    • Infringe, violate, or misappropriate the intellectual property, privacy, publicity, or other legal rights of third parties; 
    • Communicate, transmit, upload to the Site or Services or otherwise make available any content that is reasonably illegal, harmful, harassing, defamatory, pornographic, obscene, or indecent in nature, invasive of another person's privacy, likely to stir up racial or ethnic hatred, or any other content that could be harmful to your own and/or a third party's rights.
    • Send unsolicited or unauthorized advertising or commercial communications, such as spam; forge any Transmission Control Protocol (TCP) packet header or IP address or any part of the header information in any email or posting; and use the Services to send altered, false or misleading source-identifying information by any means;
    • Engaging in spidering or harvesting activities, or engaging in the use of software, including but not limited to spyware designed to collect data from the Site or Services;
    • Collect any information and/or personal data from other Users.
    • Interfering with or disrupting the proper performance of the Services, user access, the servers or networks providing the Services, or  transmitting any viruses or other computer instructions or technological means whose purpose is to interrupt, damage, or interfere with the proper use of computers or related systems;
    • Stalking, harassing, or harming another person;
    • Impersonate any natural or legal person or engage in any other similar fraudulent or abusive activity, such as phishing; Use any means to crawl or scrape any Web page contained on the Site;
    • Investigate, scan, decrypt, trace, and/or test the vulnerability of any system or network, attempt to circumvent any technological measures or authentication measures implemented by us, by our suppliers, or by third parties (including other users) intended to protect the Site or our Services;
    • Access or search, or attempt to access or search the Services by any means (automated or otherwise) other than through interfaces published by us;
    • Attempt to decipher, decompile, disassemble, or reverse engineer any software or other underlying code used to provide the Site or Services;
    • Use the Services in any other manner not permitted by these Terms; or Advocate, incite, or assist any third party to perform any of the above actions.

  3. Advertising

    The content of our games is free, therefore we require advertising to generate revenue and fund the development of our games. These advertisements, commonly referred to as "ads," are delivered to our games by advertising networks, which sell advertising services to third parties. Some ad networks do not guarantee us full control over the content displayed in the advertisements delivered to our games. If this advertisement is not to your liking, it is recommended that you do not use our applications/games. Accordingly, children under the age of 13 must be supervised by an adult when playing our games. If you are a parent or guardian and are not available to supervise your children while they play, please uninstall our games, and do not let them play.

  4. Content

    For purposes of this document, Content comprises: images, text, graphics, photos, sounds, music, videos, audio-visual combinations, interactive applications, software, scripts, works of authorship of any kind, and information or other materials that are posted, generated, provided or otherwise made available through the Services; and User Content which include: any content that you share, communicate, upload, or User Content includes communications with other users and with us, links, personal information, images, videos, and information provided by users in user profiles.

    5. The user acknowledges that by using our Site and Services he/she may be exposed to User Content that may be indecent, offensive, harmful, inaccurate, objectionable, or otherwise inappropriate or harmful to others. We do not endorse, support, represent, or guarantee the quality, integrity, truthfulness, accuracy, or reliability of any User Content, nor do we communicate or endorse any opinions expressed through the Site and Services. The user agrees that the use of the Site and Services is at his/her sole risk and responsibility.
    Ownership of All Other Content
    Please be advised that we are the rightful owner of all rights in and to (a) the Site and Services, including the software, text, media, and any other Content available on the Site and Services ("Our Content"); and (b) our trademarks, logos, domain names, and branding elements ("Brands"). The Site and Services, Our Content, and Brands are protected under copyright and trademark laws. The user may not duplicate, copy, or reuse Our Content, Our Marks, or any part of the visual design elements or concepts, HTML/CSS, or JavaScript without Capital Digital's express prior written permission.
    Removal of Content; we are entitled to:
    • Remove or refuse to distribute any Content or User Content in our sole discretion;
    • Take any action regarding any Content or User Content that we deem necessary or appropriate in our sole discretion, including taking legal action if we believe that such User Content violates these Terms of Service, infringes any intellectual property or other right of any person or entity, threatens the personal safety of Users, the Site or Services, or the public, or could result in liability to Us;
    • Disclose the user's personally identifiable information or other information about the user to any third party who claims that User Content provided by the user violates their rights, including their intellectual property rights or privacy rights;
    • Take appropriate legal action, including, without limitation, disclosing your personally identifiable information or other information about you to law enforcement agencies as a result of any illegal, suspicious, or unauthorized use of the Site or Services;
    • Cancel or suspend user access to all or part of the Site or Services.

    The user waives and releases our company (and its officers, employees, directors, shareholders, headquarters, subsidiaries, agents, and licensors "affiliates") from any and all claims arising out of your misuse of the Site or the Services offered by Capital Digital.

  5. Accounts and Access

    In order to access some features of the Site or Services, the User will not be required to create an account or password. Login is suggested only for individuals over the age of 13.
    Alternatively, our games may offer you the possibility to create an account through a social network (such as Facebook) or another service (Google account). In that case, the user authorizes us to access and use his/her Facebook or Google account information for the sole purpose of the registration. We therefore notify you that both Facebook and Google are services owned and provided by Facebook, Inc. and Google LLC. We have no responsibility for them, and we cannot guarantee their products and services in any case.

  6. Intellectual Property

    The content found within the application is the property of Capital Digital. It may not be copied, modified, or altered in any way nor our trademarks in any way. It is forbidden to attempt to extract the source code of the application, so is to attempt to translate the application into other languages or make derivative versions.
    The application itself, and all trademarks, copyrights, database rights, and other intellectual property rights related to it, remain the property of Capital Digital. We are committed to ensuring that the application is as useful and efficient as possible. Therefore, we reserve the right to make changes to the application or to charge for its services, at any time and for any reason.

  7. Information Processing

    The privacy of our Users is of great importance to us, therefore our Privacy Policy explains how we collect, use, protect, and when we share any personal information and other data with third parties.
    By accessing and/or using the Site or the Services, the user consents to the collection, use, and transfer of his/her personal information as set forth in the Privacy Policy, which forms part of these Terms of Use. Therefore, please read our Privacy Policy carefully before using the Site or Services.

  8. Connectivity

    Since our application and/or games require an active Internet connection, we disclaim that this may be via Wi-Fi or that provided by your mobile network provider (operator). However, we do not assume responsibility that our services do not have full performance if you do not have access to Wi-Fi of a stable quality or your data does not work properly.
    In the same way, it is understood that it is the user's responsibility to assume that the use of the game with his mobile network will generate a cost that he assumes and exempts us from any responsibility for this use.

  9. Updates

    From time to time it is possible that in order to provide a better service for the User we may need to update our Services for both Android and iOS platforms. The requirements for both operating systems (and for any additional systems to which we decide to extend the availability of our games) may change, and you will need to download updates if you want to continue to use our games properly. We do not commit to always updating our games to be relevant to you and/or work with the version of iOS/Android you have installed on your device. However, the user agrees to always accept updates when they are offered to ensure the proper functioning of our games.

  10. Warranty

    the use of our games is at your own risk. 
    The user agrees that the use of our application is free of charge and that the use of our games is at your own risk. 
    To the extent permitted by law, we make no warranties or representations as to the accuracy or completeness of the content of sites linked to our games or website and assume no liability for it: Errors, mistakes or inaccuracies in content, personal injury or property damage, of any nature, resulting from your access to and use of our games, any unauthorized access to or use of our secure servers and/or any personal information stored therein, any interruption or cessation of transmission to or from our games, any malicious or similar programs that may be transmitted to or through our games by any third party, any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any posted content, emailed, transmitted or made available through our games, we do not endorse, warrant or assume responsibility for any product or service advertised or offered by any third party through our games or any hyperlinked website or appearing in any banner or other advertising, we will not be a party to or be responsible in any way for the monitoring of any transaction between User and third party providers of products or services. As with the purchase of a product or service through any means or in any situation, the user should use his/her best judgment and be cautious where appropriate.

  11. Liability

    Under no circumstances shall Capital Digital, its officers, directors, employees, or agents, be liable to the user for any indirect, incidental, special, punitive, or consequential damages resulting from any: errors, mistakes, or inaccuracies in content, personal injury or property damage, of any nature, resulting from your access to and use of our games, any unauthorized access to or use of our secure servers and/or any personal and/or financial information stored therein, any interruption or cessation of transmission to or from our games, any malware or the like, which may be transmitted to or through our games by any third party, any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted or made available through our games, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages.
    The foregoing shall apply whenever consistent with the applicable jurisdiction. The User acknowledges that Capital Digital is not and shall not be liable for user submissions or for the defamatory, offensive, or illegal conduct of third parties, and that the risk of damages arising from the foregoing rests solely with the User.
    The services offered are created, controlled, and offered by us from our facilities in Mexico, that is why we are not responsible for their appropriateness or availability in other locations outside those indicated in these Terms and Conditions. Those who access or use our games from other jurisdictions do so of their own free will and are responsible for complying with local laws.

  12. Cancellation or Termination

    The User may terminate or cancel the present specifications contained herein at any time and for any reason, only by uninstalling from their device our application/game or by contacting us at [email protected].

  13. Changes

    We reserve the right to make any changes to our Terms and Conditions from time to time, making changes to accommodate new technologies, new Third Party Operator services, best practices, regulatory requirements, or other purposes. Therefore, we encourage the user to check this page periodically for any changes.
    We will notify the user of any updates by posting our new Terms and Conditions as an announcement on our social networks. These changes will be effective immediately upon posting on this page and you will be bound by them when you use or access our games after such changes are first posted.
